1. Service Provision
CSCC provides private jet chartering services, which include but are not limited to the arrangement of aircraft charter flights, ground transportation, and related concierge services. CSCC acts as an intermediary between clients and certified aircraft operators (“Operators”). CSCC itself does not own or operate aircraft.
2. Limitations of Liability
- Indirect Liability: CSCC acts solely as an agent or broker and assumes no liability for the acts, omissions, or failures of the Operators, including but not limited to aircraft performance, mechanical failures, delays, cancellations, or any other issues related to the operation of the flight.
- Direct Liability: CSCC will not be held liable for any direct, incidental, consequential, or punitive damages, including but not limited to personal injury, death, property damage, or loss arising out of or in connection with the services provided by Operators.
- Operational Control: All flights are operated by third-party Operators who maintain full operational control and responsibility over the aircraft and flight crew. CSCC does not assume any responsibility for the safety, regulation, or oversight of these flights.
3. Insurance and Responsibility
- All aircraft chartered through CSCC are operated by third-party Operators who carry appropriate aviation insurance policies as required by applicable laws and regulations. The client acknowledges and agrees that CSCC does not provide separate insurance coverage for the flight or the clients’ activities during the charter.
- The client is responsible for ensuring that they are adequately insured for all risks associated with chartering services, including but not limited to personal injury, property damage, and travel delays.
4. Force Majeure
CSCC shall not be held responsible for any failure or delay in performance due to events beyond its control, including but not limited to acts of God, war, strikes, mechanical failures, government regulations, terrorism, weather conditions, or any other unforeseen events (“Force Majeure”). In such cases, CSCC will work diligently to reschedule or reroute flights but makes no guarantee regarding the availability or cost of alternate arrangements.
5. Client Obligations
- Compliance with Laws: Clients are responsible for ensuring compliance with all applicable laws, rules, and regulations, including but not limited to customs, immigration, and FAA or other aviation authority regulations.
- Behavioral Conduct: Clients agree to abide by all rules, safety regulations, and conduct requirements set by the Operator. Failure to do so may result in termination of the flight without refund or recourse.
6. Changes, Cancellations, and Refunds
All bookings, changes, and cancellations are subject to the terms and conditions of the specific Operator. CSCC will assist clients with such requests but is not responsible for any fees, penalties, or other costs associated with cancellations, delays, or changes in flight schedules.
7. Confidentiality and Privacy
CSCC respects client confidentiality and will not disclose personal, business, or flight-related information to third parties without the client’s explicit consent, except as required by law or for the purposes of service provision.
8. Governing Law
This agreement and any disputes arising out of or relating to it shall be governed by and construed in accordance with the laws of the United States of America in which CSCC is incorporated, without regard to its conflict of laws principles.

Air Charter Broker Status
Celestial Sailing Aviation Chartering Company operates exclusively as an air charter broker and is not a direct air carrier or a direct foreign air carrier. All flights arranged by CSCC are conducted by licensed direct air carriers or direct foreign air carriers, which retain operational control over all flight aspects. CSCC facilitates the coordination of the charter but does not operate the aircraft.
Responsibility for Aircraft Operation
CSCC assumes no responsibility for the acts, omissions, or legal matters related to the operation of the aircraft provided by the direct air carrier. The direct air carrier retains full operational control of the aircraft, including flight operations and safety. Any legal matters arising from the operation of the aircraft must be addressed with the direct air carrier. CSCC’s role is limited to facilitating the charter service, and we are not liable for any operational issues or disputes. The Charterer agrees to indemnify and hold CSCC harmless for any issues related to the flight’s operation.
Medical Charters and Air Ambulance Services
CSCC is committed to the safety and well-being of our clients, particularly in medical emergency situations. All medical charters arranged by CSCC are operated by registered and certified Air Ambulance providers. These providers meet the highest standards of safety, medical care, and regulatory compliance.
- Medical Equipment: No medical charter will be conducted on aircraft that are not properly equipped for medical transport.
- Registered Providers: All medical flights are operated exclusively by Air Ambulance providers certified by the appropriate authorities.
CSCC adheres to all FAA and DOT regulations in ensuring that medical charters meet the necessary safety standards, providing peace of mind for clients requiring urgent air transportation.
General Terms and Conditions
These terms govern the booking, operation, and payment for charter flights arranged by Celestial Sailing Aviation Chartering Company (“CSCC”) on behalf of clients (“Clients”). These terms apply to all charter services provided by CSCC unless otherwise terminated in writing by either party.
Charter Services
All charter flights arranged by CSCC are subject to a confirmation process. Once a charter flight is confirmed and accepted by the client, these terms and any special conditions in the confirmation are binding on both parties. CSCC acts as an agent to arrange air transportation through direct air carriers licensed by the FAA and DOT.
Pricing
Prices quoted by CSCC include flight costs and estimated expenses. Additional costs, such as extra flight time, fuel surcharges, catering, ground transportation, de-icing, international fees, and more, are the responsibility of the client. These may be invoiced separately.
Taxes
The client is responsible for all applicable taxes, including federal excise taxes, leg segment taxes, international departure and arrival fees, and any government or airport-imposed taxes.
Payment
Prepayment of the entire quoted itinerary is required. Invoices for additional costs must be paid within ten (10) days of the invoice date. Late payments may incur interest and collection costs.
Regulations and Passenger Requirements
Flights arranged by CSCC are operated by FAA-certified direct air carriers under Part 135 of the Federal Aviation Regulations. Passengers are required to provide valid government-issued identification before boarding. Minors traveling internationally must have notarized authorization if both custodial parents are not present.
Disclosures and Liability
CSCC operates as an air charter broker, arranging flights on behalf of clients but does not own or operate aircraft. The operator retains full insurance coverage for the flight. CSCC disclaims any additional insurance coverage beyond that provided by the direct air carrier.
Liability
CSCC is not responsible for delays, cancellations, or failures due to weather, government regulations, acts of God, mechanical failures, or other causes beyond its control. CSCC disclaims any warranties beyond those explicitly stated in these terms.
Cancellations and Changes
Cancellation policies, including any fees or obligations, are outlined in the flight confirmation. By confirming a flight, the client acknowledges and accepts the cancellation terms.
Limitations of Liability
CSCC is not liable for any damages arising from flight delays, cancellations, or operational issues caused by third parties, including the direct air carrier. CSCC provides services solely as a facilitator of charter services.
Assignment and Binding Effect
These terms and conditions bind the parties and their successors. Neither party may assign their rights or obligations without the written consent of the other party.
